1. Introduction

In Plain English: These Terms are a binding legal agreement between you and Experiio. By using our website and services to search or book activities, you fully agree to follow these rules.

Welcome to Experiio. These Terms of Service (hereinafter "Terms", "Agreement") govern your access to and use of our booking software, applications, and customer support desks (collectively, "the Service").

By creating an account, browsing travel listings, or executing purchases through Experiio, you represent that you are at least 18 years of age and hold the legal capacity to enter into binding agreements. If you act on behalf of a group, you confirm you possess the explicit authority to accept these Terms for all accompanying travelers.

2. Booking & Agency

In Plain English: We help you find and pay for local activities, but we are not the operators conducting them. Slot availability and seasonal prices are regulated by the actual guides and attractions.

Experiio operates strictly as an intermediary aggregator booking platform. We do not own, operate, manage, or conduct any of the tours, transports, or guides listed on our platform.

All bookings are subject to final supplier approval and slot capacity constraints. Currency rates displayed on the Platform are updated periodically based on standard market indices, but final checkout charges depend on gateway transaction rules and card issuer conversion fees.

3. Traveler Prerequisites

In Plain English: For high-risk activities (like paragliding or diving), you must meet the physical requirements listed. Local operators can legally turn you away on safety grounds if you do not meet these criteria, without any refund.

Certain travel listings (e.g. white-water rafting, deep-sea diving, peak trekking) involve inherent physical stress or medical risks:

  • Medical Responsibility: You are solely responsible for verifying that your physical condition, age, and health history are appropriate for the selected activity. Consult your physician prior to booking high-intensity tours.
  • Safety Exclusions: Local operators reserve the right to decline service to any customer who fails to meet listed physical criteria (e.g. weight limits, breathing history, alcohol levels) or ignores safety guides. If service is refused due to safety violations, no refund will be issued.
  • Local Compliance: You must carry valid government identification and follow all local environmental and safety laws during your tour.

4. Travel Insurance

In Plain English: We highly recommend that you buy a solid travel insurance policy that covers extreme sports, medical emergencies, and sudden trip cancellations. It protects your wallet from unexpected problems.

Experiio strongly advises all users to secure comprehensive, independent travel insurance policies before starting any booked activities.

Your policy should ideally cover emergency medical transport, high-intensity adventure sports injury, trip cancellation or interruption, and baggage loss. Experiio holds no responsibility for unpaid medical bills, logistics, or transport fees incurred due to accidents during tour execution.

5. Intellectual Property

In Plain English: All software, designs, logos, and written content on Experiio belong to us. You cannot scrape, steal, or use them without our clear written permission.

All visual designs, layout systems, software source codes, text, trademarks, and graphics displayed on the Platform are the exclusive intellectual property of Experiio or licensed vendors.

You are granted a limited, personal, non-transferable, and revocable license to access our platform solely for booking travel. Scraping, reverse engineering, unauthorized API access, or redistribution of site content is strictly prohibited.

6. Liability Limits

In Plain English: Since we are only the software connecting you with local operators, we are not legally liable if something goes wrong during the tour (like accidents, delays, or guide cancellations).

To the maximum extent permitted by applicable law, Experiio and its directors, employees, and software engineers shall not be held liable for:

  • Any physical injury, property damage, or death occurring during or in connection with any booked travel experience.
  • Delays, changes in schedules, or cancellation of activities by third-party suppliers.
  • Indirect, incidental, punitive, or consequential damages arising from site downtime or booking failures.

7. Governing Law

In Plain English: Any legal issues or disputes will be governed by the laws of India, and handled exclusively by the courts in India.

This Agreement, its interpretation, and any claims arising from its execution shall be governed and analyzed under the laws of India.

Any legal actions, suits, or arbitrations relating to the Platform, payment gateways, or booking agreements shall be instituted exclusively in the competent courts located in India.
